Our platform empowers members to create detailed Family Trees and profiles, allowing you to build and expand your family's legacy. You can upload, enhance, colorize, animate, and share cherished family photos, validate relationships among family members, and keep in touch with loved ones. Additionally, you can create personalized invitations for various events, manage RSVPs, and form customized circles within our community (collectively referred to as the "Service"). The Service is owned and operated by Jagbandhu Business Solutions Pvt Ltd. (hereinafter referred to as "Jagbandhu," "we," "our," or "us").

By using our Service, "you" or "your" refers to any adult user over the age of 13. Your access to the Jagbandhu website and the Jagbandhu mobile application for iOS and Android (collectively referred to as the "Website") is conditioned upon your compliance with these Terms and Conditions. We urge you to read these terms carefully. By accessing or using the Website, you agree to be bound by these Terms and Conditions (this "Agreement"), regardless of whether you register as a member of Jagbandhu ("User"). The Website is part of a broader group of websites that we own and operate, known as the "Jagbandhu Website Group," which includes various platforms under the Jagbandhu name.

If you do not agree with any provision of this Agreement, we kindly ask that you refrain from using the Service and the Website. Please note that we reserve the right to modify any provision of this Agreement at any time at our sole discretion. Such modifications will take effect immediately upon being posted on the Website. Your continued use of the Service after any such modification constitutes your acceptance of the new terms.

The Service

Jagbandhu Family Trees, Events, and Additional Features

At Jagbandhu, we empower you as a User to create and contribute content to your Family Trees. You have the authority to control and limit access to this content by other users within the Jagbandhu Website Group. Given the nature of the Service, we encourage you to carefully consider the information you choose to post on your Family Trees or upload to the Service. We advise you to refrain from posting any illegal or inappropriate content. While we do not routinely monitor or edit user-generated content, we reserve the right to remove any content that comes to our attention which, in our sole discretion, violates this Agreement.

Jagbandhu provides additional features that enhance your experience, including:

• Event Creation and Management: Users can create and organize family events, providing an opportunity for family members to connect and celebrate together. You can manage event details, send out invitations, and track RSVPs all within the platform.
• Marketplace for Invitations: Our platform offers a marketplace where you can design and purchase personalized invitations for various occasions. This feature enables you to make your events even more special and memorable.
• RSVP Management: You can easily manage RSVPs for events through our Service, allowing you to keep track of who will be attending and streamline the planning process.

To illustrate, and without limitation, you must avoid posting, transmitting, sending, or otherwise making available, through or in connection with the Service, the following types of content:

• Explicit or Offensive Content: Photographs and other materials that include nudity, sexuality, pornography, vulgarity, violence, or any other offensive subject matter.
• Privacy Violations: Any content that infringes upon the privacy or confidentiality of others, including family members. Our Service enables you to set specific privacy settings regarding individual names, dates, email addresses, and other personally identifying information. Please utilize these features responsibly and respect the privacy of others.
• Unauthorized Personal Information: Any photos or email addresses of living individuals (other than your own) without their consent.
• Minor's Information: Information related to minors or underage children that identifies them, their personal details, or contact information, without the direct consent of their parent or guardian.
• Copyrighted Material: Any content that you do not own or do not have the right to use. This includes material that infringes upon the property or intellectual rights of others, such as copyrights and trademarks.
• Defamatory or Malicious Content: Content that is obscene, indecent, defamatory, derogatory, fraudulent, degrading, abusive, hateful, false, misleading, malicious, or otherwise offensive.
• Harassment and Threats: Content that causes alarm, annoyance, anxiety, embarrassment, offense, or distress, or incites racial, religious, or ethnic hatred.
• Malicious Code: Any computer virus or other harmful code that may damage or disrupt the functionality of the Website or the Service

In addition to the above content restrictions, you must not engage in the following behaviours:

• Impersonation: Misrepresent your identity or status, or falsely claim to be affiliated with Jagbandhu or its affiliates.
• Harassment: Stalk or harass other users, or make constant or unsolicited contact without their consent.
• Commercial Activities: Send commercial emails, spam, unsolicited bulk mail, or any other form of communication that may harass recipients.
• Reputation Damage: Use our Website or Service in a manner that could damage our name or reputation.
• Obstruction of Use: Restrict or inhibit any other person from using the Website or Service.
• Unauthorized Commercial Exploitation: Exploit any portion of the Website or Service for commercial purposes without our express permission.
• Reselling: Resell any Jagbandhu products, including invitations, without prior written consent.
• Data Harvesting: Engage in scraping, crawling, or harvesting data from the Website without explicit prior written consent.
• Legal Violations: Participate in any activity that is unlawful or that promotes or teaches unlawful activities.

You are encouraged to obtain permission from living family members before uploading information about them to a Family Tree. If you do not obtain such permission, it is the responsibility of the Family Tree owner—the Member who created the Family Tree.

In the event we receive complaints regarding information published on a Family Tree against the wishes of a person or their close relatives, we reserve the right to remove that information, even if the Family Tree owner wishes to keep it. If necessary, we may also ban the Member from the Service at our discretion.

When you upload, post, or publish content to the Website, it may become accessible to others, depending on your privacy settings. Please be aware that even if you delete content, copies may still be viewable if others have stored or downloaded it.

Acceptance of Terms

By accessing or using the JagBandhu Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. These Terms govern your use of the Services, including any content, features, and functionality that may be available through the JagBandhu platform.

Binding Agreement

Your acceptance of these Terms constitutes a binding agreement between you and JagBandhu Solutions Pvt Ltd. If you do not agree to any part of these Terms, you must not access or use the Services. Continuing to use the Services after any modifications or updates to these Terms constitutes your acceptance of the revised Terms.

Eligibility
You represent and warrant that you are at least 13 years of age, or if you are between the ages of 13 and the age of consent in your jurisdiction, that you have obtained the consent of your parent or legal guardian to use the Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

The revised Terms will become effective 30 days after they are posted, unless otherwise stated. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms. No Guarantee of Service Continuity

While we aim to provide reliable and consistent access to our Services, we cannot guarantee uninterrupted or error-free operation. There may be instances where technical issues arise that temporarily prevent access to certain features or functionalities. JagBandhu will make reasonable efforts to restore Services as quickly as possible, but we do not assume any liability for interruptions or failures in Service availability.

User Account Creation and Responsibility

To fully access and utilize the Services offered by JagBandhu, users are required to create an account. This section outlines the process for account creation, the responsibilities of users regarding their accounts, and the security measures that must be followed to ensure the integrity of the platform.

Responsibilities of Account Holders

Once an account is created, users are responsible for the following:

• Maintaining Security: Users must take appropriate steps to maintain the security of their account credentials, including not sharing their password with others and changing their password regularly to prevent unauthorized access.
• Account Activity: Users are solely responsible for all activities that occur under their account. This includes any content posted, interactions with other users, and compliance with the Community Rules and Terms of Service.
• Updating Information: Users are responsible for keeping their account information up to date. This includes providing accurate contact information and promptly updating any changes to their profile.

Account Security Measures

JagBandhu employs various security measures to protect user accounts; however, users are also encouraged to take precautions if eligible :

• Two-Factor Authentication (2FA): Users are encouraged to enable two-factor authentication for an added layer of security, where applicable.
• Reporting Unauthorized Access: If a user suspects any unauthorized access to their account, they must notify JagBandhu immediately. Users should also take steps to secure their accounts, such as changing their password.

Account Termination

JagBandhu reserves the right to suspend or terminate a user’s account if there is evidence of misuse, including but not limited to:

• Violation of Terms: Engaging in any behaviour that breaches these Terms or the Community Rules may result in account termination.
• Fraudulent Activities: Any fraudulent activity or misrepresentation of identity will not be tolerated and may lead to immediate account suspension.

Rights to Modify Account Terms

JagBandhu may update or modify the terms related to account creation and responsibilities at any time. Users will be notified of significant changes through email or in-app notifications, and it is the user's responsibility to review these changes and adjust their account practices accordingly.

Community Rules

At Jagbandhu, we believe everyone is connected as one family through the events and celebrations that shape our lives. While you may start your journey with a Family Tree, our primary aim is to create a vibrant community centred around event planning, sharing, and connection. To ensure that everyone feels welcome and safe in our community, we have established the following rules that clarify acceptable and prohibited behaviour on Jagbandhu. If you encounter any violations of these rules, please let us know, and we will do our best to address the situation. Your feedback is invaluable in helping us maintain a safe and comfortable environment for all users.

Site Access and Security
While using your Jagbandhu account or any of our services, you must:

• Comply with all applicable laws and regulations.
• Create and maintain your own Jagbandhu account, including selecting a unique username and password.
• Keep your password confidential and never share it with anyone else.
• Ensure that no child under the age of 13 is allowed to use your account or post information through it.
• Provide valid and complete contact information, including a valid email address.
• Choose a username that is respectful and appropriate, as determined by Jagbandhu in its sole discretion.
• Never misrepresent your identity to Jagbandhu or other users.
• Refrain from interfering with the services, including the use of any software program, virus, or routine to obstruct or modify Jagbandhu content or web pages.

Community Safety
While using your Jagbandhu account or any services, you may not:

• Post or share any content that is illegal, threatening, harmful, abusive, or otherwise objectionable, including content that is degrading, defamatory, vulgar, hateful, or invasive of another's privacy.
• Stalk, harass, threaten, or verbally attack any user or Jagbandhu employee, or abuse our resources, such as misusing a Jagbandhu employee’s time.
• Share false or misleading information, impersonate any person, misrepresent your affiliation with any entity (including Jagbandhu), or falsely claim an endorsement.
• Post or share content that includes any personal, proprietary, or confidential information about another person, including photos, financial information, or contact details, without their consent. This is particularly important for minors, for whom you must obtain parental or guardian consent.

Respect for Intellectual Property
While using your Jagbandhu account and our services, you may not:

• Post or share content that is protected by copyright or trademark unless you have express permission from the owner.
• Reproduce, reverse-engineer, or sell any portion of Jagbandhu’s services or content, or systematically download data from our databases for any purpose.
• “Deep link,” frame, inline link, or mirror any part of our services without written permission from Jagbandhu.

No Spam Allowed
You may not use your Jagbandhu account or services to post or share any advertising, promotional materials, junk mail, spam, chain letters, or other forms of solicitation.

Legal Details
The Jagbandhu Community Rules apply to all users of our services and are designed to protect both you and the entire Jagbandhu community. Capitalized terms used in these rules shall have the same meanings as outlined in the Jagbandhu Terms and Conditions and Privacy Statement.

This list of prohibited conduct is not exhaustive. Jagbandhu reserves the right to prohibit any activities that we determine to be offensive, interfere with the rights of others, or cause harm to any person or entity. While we cannot be responsible for the content created and shared by users, we reserve the right to remove any posts or comments that violate these rules or our Terms and Conditions.

Serious or repeated violations of these rules may result in account termination at the sole discretion of Jagbandhu.

Content Ownership

At Jagbandhu, certain services may allow you to contribute content, including but not limited to event details, photos, audio/video recordings, stories, comments, and feedback regarding our services (collectively referred to as “Your Content”). Any content that contains Personal Information will be handled in accordance with our Privacy Statement.

You control Your Content. Jagbandhu does not claim ownership rights to Your Content. You have complete control over how you choose to share Your Content within our services and are not limited in how you share it outside of Jagbandhu. You can delete Your Content by following the instructions provided within our services or by logging into your Account Settings and deleting your Account. However, if you provide feedback, comments, or suggestions about Jagbandhu or our services, you acknowledge that this information is non-confidential and non-proprietary. We may use your feedback or suggestions for any purpose without obligation or compensation to you.

By submitting Your Content, you grant Jagbandhu a non-exclusive, sub-licensable, worldwide, royalty-free license to host, store, index, copy, publish, distribute, and create derivative works of Your Content. This license is granted to allow us to provide, promote, and improve our services in line with your privacy and sharing settings. You can terminate this license by deleting Your Content, except for content shared with others that they have used. You also acknowledge that Jagbandhu owns any indexes that include Your Content and may use them even after Your Content is deleted.

You are solely responsible for your decision to create, upload, post, or share Your Content. By contributing or accessing Your Content, you agree to the following:

• You have all necessary legal rights to upload, post, or share Your Content.
• Your Content will not include any living individual without their consent, and in the case of minors, you will obtain consent from their parent or guardian.
• All Your Content will comply with the Community Rules.
• If you share Your Content publicly, other users may access and use it as part of the services. We are not required to remove Your Content once it has been publicly shared.
• You will use other users’ content only within Jagbandhu services and in accordance with these Terms and related policies.
• Jagbandhu reserves the right to monitor Your Content for violations of these Terms and the Community Rules and may remove or disable access to Your Content at our sole discretion.
• Serious or repeated violations may lead to account termination at Jagbandhu’s discretion.

We respect the intellectual property rights of others. If you believe that any content violates the Community Rules, infringes your rights, contains illegal material, or violates these Terms, please contact us. For complaints regarding copyright infringement or to submit a copyright infringement notice and takedown request, reach out to us directly.

User Content and Ownership

JagBandhu encourages users to actively engage with the platform by contributing various forms of content, which may include, but are not limited to, event invitations, photos, stories, comments, and other multimedia content (“Your Content”). By participating in the community, users help create a rich and engaging environment that enhances the experience for all members.

Control and Ownership of Your Content

Users retain ownership of all rights, titles, and interests in their content. However, by submitting Your Content to JagBandhu, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display Your Content for the purposes of providing, promoting, and improving the Services. This license is granted in accordance with your privacy settings and can be revoked by deleting Your Content, except where it has already been shared with other users.

Responsibilities Regarding Your Content

Users are responsible for ensuring that their contributions comply with the Community Rules and applicable laws. This includes:

• Ownership Rights: Users must have all necessary rights and permissions to share their content, ensuring that it does not infringe on the rights of others.
• Consent: If Your Content includes the likeness or information of other individuals, users must obtain their consent before posting. This is especially important for minors, where consent from a parent or guardian is required.

To the fullest extent permitted by applicable law, Jagbandhu, including its officers, agents, representatives, employees, licensors, and affiliates, shall not be liable for any incorrect or inaccurate information related to the Services. This includes information provided by users, members, advertisers, or corporate partners, as well as any equipment or programming associated with the operation of the Services.

Jagbandhu and its licensors and affiliates are not responsible for the conduct of any member or user of the Services, whether online or offline. In no event shall we be liable for any loss or damage, including lost data, personal injury, or privacy implications arising from your use of the Services, any information posted or transmitted through the Services, or interactions between users.

The information, products, and services available through the Services may contain inaccuracies or typographical errors, and changes may be made periodically.

Jagbandhu assumes no responsibility for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, or unauthorized access to user communications. We are not liable for any problems or technical malfunctions of any telephone networks, computer systems, or software that may occur due to technical issues or internet traffic congestion. Jagbandhu and its affiliates are not responsible for any injury or damage to your computer or equipment arising from your use of the Services or downloading any materials from the Services.

To the extent permitted by law, Jagbandhu expressly disclaims all warranties, whether expressed or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. These limitations shall apply to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so this limitation may not apply to you. If you are dissatisfied with any part of the Services or any terms of this Agreement, your sole remedy is to discontinue use of the Services.

Indemnity

You agree to indemnify and hold harmless Jagbandhu, its subsidiaries, employees, directors, agents, licensors, managers, and any third party acting on our behalf from any loss, liability, claim, or demand, including reasonable attorneys' fees, arising from your use of or access to the Services, your violation of this Agreement, any breach of your representations and warranties, or any information you post on the Services that causes us to be liable to any third party.

Changes to the Terms and Conditions

We reserve the right to modify these Terms at any time and will notify you of material changes by posting information through the Services or sending you an email. Material changes will take effect thirty days after posting, except for changes addressing new Services or legal requirements, which will take effect immediately. Your continued use of the Services after any modifications indicates your acceptance of the modified Terms. If you do not agree to the changes, you should discontinue using the Services and, if applicable, cancel your subscription.

No Liability for Modifications

JagBandhu will not be liable to you or any third party for any modifications, suspensions, or discontinuations of the Services. Your continued use of the Services following any modification indicates your acceptance of the modified Services.

Severability

Definition

Severability refers to the legal principle that allows individual provisions of an agreement to be enforced independently of one another. If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions will continue to be in full force and effect.

Enforceability

In the event that any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity and enforceability of the remaining provisions. The remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

Reformation of Invalid Provisions

If any provision of these Terms is found to be invalid or unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision. Furthermore, any invalid or unenforceable provision shall be modified to the least extent necessary to make it valid and enforceable.

No Waiver of Rights

The failure of JagBandhu to enforce any right or provision in these Terms shall not be deemed a waiver of such right or provision. Any waiver of any term of these Terms will be effective only if in writing and signed by an authorized representative of JagBandhu.

Termination

We reserve the right to limit, suspend, or terminate your access to the Services if you violate these Terms or act in a manner inconsistent with them, including the Community Rules. In such cases, you will not be entitled to a refund of any subscription fees or other monetary purchases you have made.

Governing Law

If you access the Services from India, the laws of the State of Telangana and, where applicable, the laws of India, will govern these Terms and your use of the Services. You agree that any claims not subject to arbitration and brought in India will be under the exclusive jurisdiction of the competent courts located in the State of Telangana. If you access the Services from outside India, the laws of India will govern these Terms.
